PREAMBLE:

The tailor-made and à la carte travel services, as well as the rallies offered on the watt-rally.com website and existing on the date of publication of these Terms, are organised and sold under the Watt Rally brand by ACCESS ORGANISATION GROUP, a French limited liability company (SARL) with a share capital of €10,000.00, whose registered office is located at 2 Rue Héraclès, Parc Racine, 59650 VILLENEUVE-D’ASCQ, FRANCE, registered with the Lille Métropole Trade and Companies Register under number 451 354 518 and registered with Atout France under number IM059110031, represented by its Managing Partner, Mr Jeoffrey DECOUPIGNY (hereinafter “ACCESS ORGANISATION GROUP”).

The financial guarantee intended to guarantee all funds received, pursuant to Articles L. 211-18 and R. 211-26 to R. 211-34 of the French Tourism Code, is provided by ARCUS – Professional Civil Liability Insurance: HISCOX (Policy RCP0224777).

These Special Terms and Conditions of Sale (“Terms”) govern any booking made by a Client via the Internet, electronically, by telephone or by post. They supplement the pre-contractual information provided to the Client within the meaning of Article R.211-4 of the French Tourism Code. In the event of any conflict between these Terms and specific conditions stated in the description of a Service, the latter shall prevail.

The Client’s validation of a contract constitutes full and unconditional acceptance of these Terms, which are available online and may be printed. Refusal to accept these Terms makes it impossible to make any booking or use the services offered.

These published Terms cancel and replace any previous version.

DEFINITIONS

Client: Any person purchasing tourism services.

Booking: A firm purchase of a Service accepted by ACCESS ORGANISATION GROUP.

Travel Contract: The contractual agreement consisting of these Terms, the quotation accepted by the Client and the description of the trip.

Description: Details of the characteristics of a Service available on the Website.

Travel Agency: Watt Rally, a registered trademark operated by ACCESS ORGANISATION GROUP.

Package Holiday : A combination of services (>24 hours or including an overnight stay) sold at an inclusive price.

Service Provider: Any entity providing a service (hotel, guide, etc.).

Service: A service offered to the Client (rally, etc.).

Reservation: A request for a Service processed and approved by ACCESS ORGANISATION GROUP.

Website: watt-rally.com and any other website affiliated with ACCESS ORGANISATION GROUP.

1/ BOOKING & REGISTRATION

ACCESS ORGANISATION GROUP offers motor rallies and tailor-made trips through its dedicated platforms. Booking a Service implies full and unconditional acceptance of these Terms.

The Client is responsible for the accuracy of the information provided (surname, first name, passport number, contact details, etc.). Particular attention must be paid to reviewing the contract before confirming it. ACCESS ORGANISATION GROUP cannot be held liable for any errors that have not been reported.

Registration becomes effective after approval by ACCESS ORGANISATION GROUP and receipt of the deposit and full payment in accordance with the terms set out below.

  • For any booking made more than 60 days before departure: a deposit of 30% of the total amount is required at the time of booking. The balance must be paid no later than 60 days before departure, without reminder.
  • For any booking made less than 60 days before departure: full payment is required at the time of booking.

In the event of failure to comply with these conditions, ACCESS ORGANISATION GROUP reserves the right to cancel the booking without compensation.

The Client must be of legal age (18 years or older), hold a valid Category B driving licence, and each crew must consist of at least one person in order to participate in the rally.

2/ PRICES AND PAYMENT TERMS

2.1 PRICING

The total price of the Service is the price stated on the booking confirmation sent by ACCESS ORGANISATION GROUP. It is expressed in Euros and includes all applicable taxes. No dispute concerning the price of the trip may be considered after the Client’s return, as the Client determines before departure whether the price is acceptable, acknowledging in the case of package holidays that it is an inclusive price comprising services whose individual prices are not itemised by the Travel Agency.

Prices are indivisible and any decision not to use Services included in the Contract, or any interruption of the trip by the Client (including in the event of hospitalisation or early repatriation), shall not entitle the Client to any refund, except where covered by specific insurance. Only Services expressly mentioned in the trip description form part of the Package.

The following are not included in the package (unless otherwise stated in the trip description):

  • Vaccination and visa costs;
  • Personal expenses (tips, telephone charges, various deposits, etc.);
  • Optional excursions and, more generally, any service not expressly mentioned in the Travel Contract;
  • Drinks during meals (including bottled water where the Service Provider does not have access to safe drinking water).

Manifestly incorrect price: if, as a result of a material error, the price displayed on the Website or communicated to the Client by any other means is manifestly derisory or abnormally low in relation to the objective value of the Service, ACCESS ORGANISATION GROUP may cancel the booking without any charge or penalty. The Client may make a new booking subject to availability and at the correct price of the Services.

2.2 PAYMENT TERMS

Payment may be made by bank card (secure online payment), bank transfer, or cheque (accepted only more than 60 days before departure).

  • Deposit: 30% of the total amount at the time of booking, where the booking is made more than 60 days before departure.
  • Balance: payable without reminder no later than 60 days before departure.

Failure to comply with payment deadlines entitles ACCESS ORGANISATION GROUP to cancel the booking and apply the cancellation charges provided for in Article 4. Payment shall only be considered effective once the funds have been received.

In accordance with Article L.132-2 of the French Monetary and Financial Code, any payment by bank card is irrevocable, except in the event of loss, theft or fraudulent use.

ACCESS ORGANISATION GROUP uses a secure payment system and guarantees the confidentiality of banking information in accordance with personal data protection regulations.

3/ ADMINISTRATIVE AND HEALTH INFORMATION

3.1 FORMALITIES

The Client is solely responsible for completing all administrative, health, customs and police formalities required to undertake the trip.

Foreign nationals must contact their relevant consular authority to determine the specific formalities applicable to them. ACCESS ORGANISATION GROUP cannot be held liable in the event of refusal of boarding or entry into a country as a result of failure to comply with these obligations.

3.2 MANDATORY DOCUMENTS AND INSURANCE

Each participant must have:

  • A valid identity document, valid 60 days before departure and covering the rally dates;
  • The vehicle registration certificate, available 60 days before departure;
  • A valid driving licence (Category B);
  • Motor vehicle insurance covering the countries travelled through;
  • A valid vehicle roadworthiness inspection;
  • Mandatory assistance and repatriation insurance taken out through ACCESS ORGANISATION GROUP or equivalent cover.
  • A blood group certificate and details of any allergies are also required.

If the required documents cannot be presented at the time of registration confirmation or departure, no refund may be claimed.

3.3 HEALTH INFORMATION

ACCESS ORGANISATION GROUP informs the Client that it is the Client’s responsibility to obtain information regarding the health requirements of the countries travelled through and to take any necessary preventive measures. It is recommended that the following websites be consulted:

ACCESS ORGANISATION GROUP accepts no liability in the event of refusal of boarding, quarantine or interruption of the trip resulting from failure to comply with health requirements.

4/ AMENDMENT AND CANCELLATION CONDITIONS

4.1 AMENDMENT OR CANCELLATION OF SERVICES BY THE CLIENT BEFORE DEPARTURE WITHOUT CANCELLATION OF THE ENTIRE TRIP

Such requests do not alter the essential elements of the Travel Contract:

No Service included in the Travel Contract may be modified free of charge less than 60 days before the departure date. Administration fees for amendments to the booking will be charged as follows:

  • More than 30 days before departure: €25 per person;
  • Between 30 and 21 days before departure: €50 per person;
  • Between 20 and 8 days before departure: €80 per person;
  • From 8 days before departure up to and including the day of departure: €100 per person.

The following written amendment requests shall be considered cancellations of the Travel Contract because they concern essential elements of the Travel Contract and therefore fall within Article 4.2 of these Terms:

  • Change of participant names;
  • Change of vehicle registration;
  • Cancellation of Services.

4.2 CANCELLATION OF THE TRIP BY THE CLIENT BEFORE DEPARTURE

In accordance with Article L221-28-12° of the French Consumer Code, this Contract is not subject to any right of withdrawal.

However, the Client may terminate the Contract at any time before the start of the trip subject to payment of the following cancellation charges (without prejudice to any specific charges stated in the description of the selected product):

Charges applicable in the event of cancellation by the Client (based on the total price of the trip):

  • From the date of booking to more than 60 days before departure: non-refundable deposit (30%);
  • From 60 days to more than 45 days before departure: 60% charge per person;
  • From 45 days to more than 15 days before departure: 80% charge per person;
  • From 15 days before departure up to the departure date: 100% charge per person.

Any cancellation request must be sent in writing to ACCESS ORGANISATION GROUP by registered letter with acknowledgement of receipt (LRAR) to the following address: 2 Rue Héraclès, Parc Racine, 59650 VILLENEUVE-D’ASCQ, FRANCE. The postmark date shall be used to determine the applicable cancellation charges.

4.3 ADDITIONAL PROVISIONS

Any trip interrupted or shortened, or any Service not used due to the Client’s own decision, shall not give rise to any refund. Where the Client has taken out optional insurance covering, in particular, interruption of the trip, the Client must comply with the cancellation procedures set out in the General and Special Conditions of the insurance policy.

4.4 AMENDMENT OF SERVICES BY ACCESS ORGANISATION GROUP BEFORE DEPARTURE

ACCESS ORGANISATION GROUP reserves the right to unilaterally amend the provisions of the Contract before the start of the trip, provided that the amendment is minor. In all cases, ACCESS ORGANISATION GROUP shall inform the Client on a durable medium as quickly as possible.

In the event of an external event affecting ACCESS ORGANISATION GROUP before departure and making it impossible for ACCESS ORGANISATION GROUP to fulfil the essential elements of the Contract, ACCESS ORGANISATION GROUP shall inform the Client and offer the Client the choice of either accepting an amendment to the Services or terminating the Contract without charge.

4.5 AMENDMENT OF SERVICES BY ACCESS ORGANISATION GROUP AFTER DEPARTURE

If, after departure, an essential element of the Contract cannot be performed within the meaning of Article L.211-16-V and VI of the French Tourism Code, and except in cases of extraordinary and unavoidable circumstances, ACCESS ORGANISATION GROUP shall, at its own expense, offer replacement Services or, where the replacement Services are of a lower quality, reimburse the difference in price, or arrange the Client’s early return.

4.6 CANCELLATION OF THE TRIP BY ACCESS ORGANISATION GROUP

If ACCESS ORGANISATION GROUP is prevented from performing the Contract due to extraordinary and unavoidable circumstances, it shall notify the Client of the termination of the Contract as soon as possible before the start of the trip and, where applicable, offer either postponement or a full refund of payments made.

5/ GROUND SERVICES AND ACCOMMODATION

5.1 CONDITIONS OF THE OFFER

As a general rule in the hotel industry, rooms are available from 3:00 p.m. and must be vacated before 12:00 noon, regardless of the return schedule. ACCESS ORGANISATION GROUP cannot under any circumstances depart from this rule. Any room occupied before 3:00 p.m. or vacated after 12:00 noon is considered as an additional night used. Prices are calculated according to the number of nights rather than the number of days.

5.2 HOTEL CLASSIFICATION

The number of stars awarded to the hotel establishment stated in the description corresponds to a classification established according to local standards in the host country and may therefore differ from French, European or international standards. ACCESS ORGANISATION GROUP provides the most accurate information possible regarding the characteristics of your accommodation. The assessments provided by ACCESS ORGANISATION GROUP in its descriptions are based, in particular, on its knowledge of the establishments and feedback received from its Clients.

5.3 POSSIBLE CHANGES

Where necessary (force majeure, safety or operational reasons), ACCESS ORGANISATION GROUP or its Service Providers may be required to change certain accommodation or stages of the itinerary while maintaining an equivalent standard of quality. The Client shall be informed as soon as possible.

Similarly, the direction of itineraries may be reversed or modified without altering the content of the programme.

5.4 ACTIVITIES AND ON-SITE SERVICES

Certain activities included in the description may be suspended for climatic or technical reasons, or if the minimum number of participants is not reached. ACCESS ORGANISATION GROUP cannot be held liable for the cancellation or modification of such activities by its Service Providers.

The Client is advised to check that their personal insurance covers the activities offered during the trip.

5.5 PHOTOGRAPHS AND ILLUSTRATIONS

ACCESS ORGANISATION GROUP endeavours to illustrate its offers with photographs or illustrations providing a realistic overview of the Services offered. However, photographs and illustrations appearing in the description are provided for illustrative purposes only. They shall only bind ACCESS ORGANISATION GROUP insofar as they indicate the category or standard of the Services concerned.

6/ INSURANCE

ACCESS ORGANISATION GROUP strongly recommends that its Clients take out insurance covering risks specific to travel, such as cancellation, illness, accidents, natural disasters, medical repatriation, etc.

ACCESS ORGANISATION offers a range of insurance products suited to these requirements and invites its Clients to review the terms, prices and exclusions by consulting the descriptions below; its advisers are available to Clients for any further information. In the event of a claim, before or during the trip, it is the Client’s responsibility to report the claim without delay (please refer to the insurance contract) to AXA ASSISTANCE in order to initiate the appropriate procedure and to inform ACCESS ORGANISATION GROUP at the same time.

7/ LIABILITY, PENALTIES AND EXCLUSIONS

ACCESS ORGANISATION and, where applicable, the organiser, is/are responsible for the proper performance of the Services provided for in the Contract in accordance with Article L. 211-16 of the French Tourism Code and are required to provide assistance to travellers in difficulty in accordance with Article L. 211-17-1 of the aforementioned Code.

However, in the event of any lack of conformity identified by the Client during the performance of a travel service included in the Contract, it is recalled that, pursuant to the law, the Client is required to inform ACCESS ORGANISATION GROUP and/or, where applicable, the organiser, as soon as possible.

Failure to report a lack of conformity while on site may affect the amount of any damages or price reduction payable where reporting the issue without delay could have prevented or reduced the damage suffered by the Client.

ACCESS ORGANISATION GROUP shall also provide assistance to any traveller in difficulty as quickly as possible, taking into account the circumstances of the case. Where its strict liability applies as a result of the actions of its Service Providers within the meaning of the aforementioned Article, the compensation limits provided for in Article L. 211-17 IV of the French Tourism Code shall apply; failing this, and except in the case of personal injury, intentional damage or damage caused by negligence, any damages shall be limited to three (3) times the amount of the trip or stay.

The Client is informed that ACCESS ORGANISATION GROUP, or where applicable the organiser, cannot under any circumstances be held liable for non-performance or improper performance of all or part of the Services provided for in the Contract where this is attributable either to the Client, to an unforeseeable and unavoidable act of a third party unrelated to the provision of the Service, or to extraordinary and unavoidable circumstances.

ACCESS ORGANISATION GROUP shall also accept no liability and cannot assume financial responsibility on behalf of the Client in the following circumstances:

  • Costs arising from the Client’s loss of transport tickets (fees and penalties for reissuing tickets and resulting costs, particularly where the Client is stranded in the country);
  • Debts incurred by the Client with a third party (hotel extras, etc.);
  • Loss of identity documents or any other document required to leave the country visited and return to France;
  • Cover and organisation of the Client’s return in the event of a force majeure event occurring during the trip;
  • Any incident occurring in connection with Services purchased outside the Contract directly by the Client from an external Service Provider at the destination or resulting from the Client’s personal initiative;
  • In the event of cancellation of the trip by the Client, insurance premiums and visa fees are never refundable. ACCESS ORGANISATION GROUP informs the Client of the existence of specific insurance contracts covering the consequences of cancellation (see Article 6 of these Terms).

Definition of force majeure. Force majeure is defined as any event external to the parties that is both unforeseeable and unavoidable and prevents the Client and/or the Agency/its suppliers from performing all or part of the obligations provided for in the Contract (riots, wars, political unrest, health situations, pollution, natural and/or climatic events).

Before departure. In the event of cancellations imposed by force majeure circumstances and/or justified by the protection of our Clients’ safety and/or ordered by an administrative authority, Clients shall not be entitled to any additional compensation. ACCESS ORGANISATION GROUP may, in particular and in accordance with the provisions of the French Tourism Code, propose changes to the planned dates, schedules and itineraries. Any accepted changes shall be borne by the Client. After departure, where a force majeure event occurs, the obligations of the parties shall be suspended. Any delays incurred and any resulting changes to the itinerary shall not give rise to compensation of any kind, including as a result of changes to the duration of the programme initially planned or delays in making a connection. Any additional costs resulting from a disruption (taxes, hotel accommodation, change of means of transport, parking, etc.) shall remain the responsibility of the Client.

ACCESS ORGANISATION GROUP accepts no liability for any mechanical problems occurring before, during or after the trip. ACCESS ORGANISATION GROUP has no obligation to provide mechanical assistance. The information contained in the roadbook supplied by the Agency shall not incur its liability. The roadbook is an advisory document and participants remain free to use it at their own discretion.

7.1/ LIABILITY, PENALTIES AND EXCLUSIONS APPLICABLE TO OUR RALLIES

ACCESS ORGANISATION GROUP cannot be held liable in the event of theft of or damage to property belonging to participants. ACCESS ORGANISATION GROUP therefore accepts no liability towards participating crews in this respect. By registering for Watt Rally, the Client accepts the penalties specified in the general event regulations. In the event of a penalty or exclusion decided by the organisation, the Client shall not be entitled to claim a refund of the registration fees. Where the vehicle does not comply with the requirements set by the organisation, the crew shall have 24 hours to bring the vehicle into compliance. Once this period has expired, the crew shall not be permitted to start the rally and no refund shall be granted.

8/ IMAGE RIGHTS

By registering for the trip, the Client expressly authorises ACCESS ORGANISATION GROUP, without financial compensation, to use their image on all media, including websites, social media, printed materials, photographs and videos, for commercial or communication purposes.

9/ TRANSFER OF THE CONTRACT BY THE CLIENT

In accordance with Article L.211-11 of the French Tourism Code, the Client may transfer the Contract to a third party who meets the same conditions for participation in the trip.

The Client must inform ACCESS ORGANISATION GROUP of the transfer on a durable medium no later than seventy-five (60) days before the start date of the trip. This request must specify the full identity and contact details of the transferee and make it possible to verify that the transferee meets the same participation requirements as the original Client.

The transfer shall only become effective after express approval by ACCESS ORGANISATION GROUP, receipt of the required documents, and acceptance by the transferee of these Terms and Conditions of Sale and the event regulations.

The transferor and transferee shall be jointly and severally liable for payment of any outstanding balance of the trip price, as well as any fees, charges or other additional costs resulting from the transfer.

An administrative transfer fee of one hundred and fifty euros (€150 including tax) shall be charged to the transferee for processing the amendment to the booking. The transfer shall only be taken into account once this fee has been paid in full.

ACCESS ORGANISATION GROUP reserves the right to refuse the transfer if the transferee does not meet the participation requirements, if the documentation submitted is incomplete, or if the request is made after the applicable deadline.

Any insurance contracts taken out by the Client cannot be transferred to a third party.

10/ PERSONAL DATA PROTECTION

ACCESS ORGANISATION GROUP collects and processes the personal data of the Client and other travellers in accordance with its Privacy Policy.

11/ COMPLAINTS AND MEDIATION

ACCESS ORGANISATION GROUP recommends that any problem relating to non-performance or improper performance of Services during the trip be reported to the organisation team as soon as possible. To ensure prompt handling of your case, any complaint must be sent to ACCESS ORGANISATION GROUP by registered letter within 30 days following return from the trip to the following address: Watt Rally – ACCESS ORGANISATION GROUP – 2 Rue Héraclès – Parc Racine – 59650 VILLENEUVE-D’ASCQ – FRANCE or by email to contact@watt-rally.com. If no satisfactory response is received within 60 days, Clients may contact the French Tourism and Travel Mediator (Médiateur du Tourisme et du Voyage) free of charge. Its contact details and referral procedures are available at: https://mtv.travel. Where the trip is sold online, the Client may use the platform available at https://webgate.ec.europa.eu/odr to resolve the dispute.

12/ APPLICABLE LAW AND JURISDICTION

The Contract shall in all respects be governed by French law.

In the absence of an amicable resolution obtained in accordance with Article 11, any dispute arising from the conclusion, interpretation, performance and/or termination of the Contract shall be subject to the exclusive jurisdiction of the Courts of LILLE.

13/ REVISION OF THE TERMS AND CONDITIONS OF SALE

The applicable version of the Terms and Conditions of Sale shall be the version in force on the date of booking. ACCESS ORGANISATION GROUP reserves the right to amend or update its Terms and Conditions of Sale at any time and without prior notice: the Terms and Conditions of Sale shall become effective as soon as they are published on the Website.
